Welcome to India Domestic Worker Provider (IDWP). These Terms and Conditions govern your use of our website, platform, and services. By accessing or using our services, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.

1Definitions

  • "IDWP," "we," "us," or "our" refers to India Domestic Worker Provider, the platform operator.
  • "Customer," "you," or "your" refers to individuals or entities using our services to find domestic workers.
  • "Worker" refers to domestic workers registered on our platform (maids, cooks, nannies, caregivers, etc.).
  • "Platform" refers to our website, mobile application, and all related services.
  • "Services" refers to worker placement, profile matching, verification, and related services provided by IDWP.
  • "Booking Fee" refers to the ₹99 non-refundable fee charged for processing bookings.

2Acceptance of Terms

By using our platform, you acknowledge that:

  • You have read, understood, and agree to be bound by these Terms and Conditions
  • You agree to comply with all applicable laws and regulations
  • You are at least 18 years of age or have parental/guardian consent
  • You have the legal capacity to enter into binding contracts
  • You agree to our Privacy Policy and Cancellation & Refunds Policy

3Services Provided

IDWP provides the following services:

  • Worker Matching: Connecting customers with verified domestic workers based on requirements
  • Background Verification: Conducting basic verification of worker identity and credentials
  • Profile Sharing: Providing detailed worker profiles including experience, skills, and references
  • Interview Coordination: Facilitating interviews between customers and workers
  • Placement Support: Assisting with the hiring process and initial placement
  • Customer Support: Providing ongoing support for queries and issues

3.1 What We Do NOT Provide

  • We are NOT an employment agency or direct employer of workers
  • We do NOT guarantee worker performance, behavior, or suitability
  • We are NOT responsible for employment contracts between customers and workers
  • We do NOT handle salary payments or employment disputes
  • We are NOT liable for any incidents occurring after placement

4Booking and Payment Terms

4.1 Booking Process

  1. 1.Browse worker profiles or submit a booking request with your requirements
  2. 2.Pay the non-refundable booking fee of ₹99 via our secure payment gateway
  3. 3.Receive booking confirmation via email and SMS
  4. 4.Our team will share matched worker profiles within 24-48 hours
  5. 5.Schedule interviews with shortlisted workers
  6. 6.Finalize hiring and employment terms directly with the worker

4.2 Payment Terms

  • The booking fee of ₹99 is non-refundable under all circumstances
  • Payment must be completed before booking confirmation
  • We accept UPI, credit/debit cards, net banking, and digital wallets via Razorpay
  • All prices are in Indian Rupees (INR) and inclusive of applicable taxes
  • Worker salaries and compensation are negotiated directly between customer and worker

4.3 Booking Validity

Your booking remains valid for 30 days from the date of payment. During this period:

  • You can request worker profile replacements at no additional cost
  • You can schedule multiple interviews with different workers
  • You have access to customer support for assistance
  • After 30 days, you may need to create a new booking for continued service

5Customer Responsibilities

As a customer using our platform, you agree to:

  • Provide Accurate Information: Submit truthful and complete information during booking
  • Conduct Due Diligence: Interview workers thoroughly and verify credentials before hiring
  • Comply with Labor Laws: Follow all applicable employment laws and regulations
  • Treat Workers Respectfully: Ensure fair treatment, safe working conditions, and timely payment
  • Maintain Confidentiality: Protect worker personal information and privacy
  • Report Issues: Notify us immediately of any problems or concerns
  • Use Platform Appropriately: Do not misuse, abuse, or exploit our services

6Worker Verification and Liability

6.1 Verification Process

We conduct basic verification of workers, including:

  • Identity verification (Aadhaar, PAN, voter ID)
  • Contact information verification
  • Reference checks (when available)
  • Work experience validation

6.2 Limitations of Liability

IMPORTANT: While we conduct basic verification, we cannot guarantee:

  • Worker honesty, integrity, or character
  • Worker skills, competence, or performance
  • Absence of criminal history or misconduct
  • Worker reliability, punctuality, or commitment
  • Compatibility between customer and worker

⚠️ Disclaimer: IDWP is NOT responsible for any loss, damage, theft, injury, or misconduct caused by workers after placement. Customers are solely responsible for conducting their own due diligence and making hiring decisions.

7Intellectual Property Rights

All content on our platform is protected by intellectual property laws:

  • Ownership: All website content, logos, trademarks, and materials are owned by IDWP
  • Restrictions: You may not copy, reproduce, distribute, or modify our content without permission
  • License: We grant you a limited, non-exclusive license to access and use our platform for personal use
  • Trademarks: "India Domestic Worker Provider" and "IDWP" are our registered trademarks

8Prohibited Activities

You agree NOT to engage in the following activities:

  • Providing false or misleading information
  • Impersonating another person or entity
  • Harassing, abusing, or threatening workers or staff
  • Using the platform for illegal or unauthorized purposes
  • Attempting to hack, disrupt, or damage our platform
  • Scraping, data mining, or extracting worker information
  • Circumventing our booking process or payment system
  • Posting spam, malware, or malicious content
  • Violating any applicable laws or regulations

Violation of these terms may result in immediate account suspension or termination.

9Termination

9.1 Termination by Customer

You may stop using our services at any time. However, the booking fee is non-refundable.

9.2 Termination by IDWP

We reserve the right to suspend or terminate your access to our platform if:

  • You violate these Terms and Conditions
  • You engage in prohibited activities
  • You provide false or fraudulent information
  • Your actions harm our platform, workers, or other customers
  • We are required to do so by law

10Dispute Resolution

10.1 Informal Resolution

If you have any disputes or complaints, please contact us first. We will attempt to resolve the issue amicably.

10.2 Governing Law

These Terms and Conditions are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of courts in Gurugram, Haryana.

10.3 Arbitration

If informal resolution fails, disputes may be resolved through binding arbitration in accordance with Indian arbitration laws.

11Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • IDWP is NOT liable for any direct, indirect, incidental, or consequential damages
  • Our total liability is limited to the booking fee paid (₹99)
  • We are NOT responsible for worker actions, misconduct, or negligence
  • We are NOT liable for employment disputes between customers and workers
  • We provide services "as is" without warranties of any kind

12Changes to Terms

We reserve the right to modify these Terms and Conditions at any time:

  • Changes will be posted on this page with an updated date
  • Significant changes will be notified via email
  • Continued use after changes constitutes acceptance
  • We encourage you to review these terms periodically
